Legal Associate

SARFAESI Act Proceedings:

• Draft and issue notices under section 13(4) of the SARFAESI Act.
• Coordinate with Phoenix team and take possession of secured assets (symbolic and physical).
• File applications before the Debt Recovery Tribunal (DRT).
• Assist in auction and enforcement of security interests.

2. Section 138 of the Negotiable Instruments Act (Cheque Bounce Cases):

• Draft legal notices to defaulters under Section 138.
• File complaints before the Magistrate Court.
• Coordinate with external legal counsel and attend hearings.
• Track case progress and maintain updates for management.

3. Banking Litigation &

Recovery:

• Represent the bank/NBFC in civil suits, arbitration, and other legal proceedings.
• Manage litigation before DRT, DRAT, Civil Courts, Criminal Courts, and High Courts.
• Handle matters related to loan recovery, enforcement of guarantees, fraud, and wilful defaulters.
• Maintain case records, court dates, and MIS reports on ongoing litigations.

4. External Coordination:

• Liaise with external advocates and law firms for case updates, strategy, and documentation.
• Coordinate with internal stakeholders such as credit, recovery, and risk teams.

5. Compliance & Documentation:

• Ensure all actions are in line with RBI guidelines, SARFAESI procedures, and applicable laws.
• Prepare board notes, legal opinions, and internal memos on litigation matters.

Required Qualifications & Skills:

• Bachelor’s Degree in Law (LL.B). Master’s in Law (LL.M) is an advantage.
• Enrolled with the Bar Council of India.
• 3–7 years of legal experience, preferably in banking, NBFCs, or recovery law firms.
• In-depth knowledge of SARFAESI Act, NI Act (Sec 138), DRT Act, CPC, CrPC, and RBI norms.
• Strong drafting, legal research, and analytical skills.
• Willingness to travel for court hearings or property possession drives.
• Proficiency in maintaining case MIS, legal dashboards, and internal reporting.
