Job Description

Position: In-House Legal Head – Real Estate & Hospitality

Location: Chembur, Mumbai

Reporting To: CEO / Project Head & Director

ROLE OVERVIEW

The In-House Legal Head will be responsible for actively coordinating and working in tandem with the appointed external Law Firm for all critical legal matters.

This role ensures that all legal documentation, registrations, statutory compliance, dispute handling, and record maintenance are executed efficiently, accurately, and in strict compliance with applicable laws, while maintaining seamless communication between internal teams, the Society, and external legal counsel.

KEY RESPONSIBILITIES

A. REDEVELOPMENT DOCUMENTATION & AGREEMENTS (WITH LAW FIRM COORDINATION)

1.    Draft, review, finalize, and coordinate with the external Law Firm on all redevelopment documents including:

o  Letter of Intent (LOI)

o  Memorandum of Understanding (MOU)

o  Development Agreement (DA)

o  Permanent Alternate Accommodation Agreement (PAAA)

o  Power of Attorney (POA)

o  Supplemental deeds, indemnities, declarations, and undertakings

2.    Ensure all drafts are:

o  Legally vetted by the Law Firm

o  Aligned with redevelopment laws and approvals

o  Approved internally before execution

3.    Coordinate execution, stamping, and registration of documents in consultation with the Law Firm and Sub-Registrar offices.

B. SOCIETY & MEMBER LEGAL COORDINATION

4.    Act as the single legal coordination point between:

o  Society Managing Committee

o  Individual members

o  External Law Firm

5.    Coordinate with the Law Firm for:

o  Member-specific legal clarifications

o  Handling objections, dissent, or special cases

o  Drafting member-specific annexures or undertakings

6.    Maintain member-wise legal records, vetted and standardized in consultation with the Law Firm.

C. TITLE DUE DILIGENCE & LAND MATTERS

7.    Coordinate with the Law Firm on:

o  Title search and verification

o  CTS / Property Card / City Survey documentation

o  Sub-division legal documentation

o  Mutation and revenue record updates

8.    Ensure all title and land-related legal clearances are completed prior to:

o  Development Agreement execution

o  Power of Attorney issuance

o  RERA registration

D. REGULATORY & RERA COMPLIANCE

9.    Coordinate with the Law Firm, Architect, Engineer, and CA for:

o  RERA registration documentation

o  Legal declarations and affidavits

o  Quarterly RERA updates

o  Amendments or modifications in RERA filings

10. Ensure all RERA-related legal requirements are vetted and approved by the Law Firm before submission.

E. DISPUTE MANAGEMENT & LITIGATION COORDINATION

11. Handle all legal notices by:

  • Drafting initial responses
  • Coordinating strategy and final responses with the Law Firm

12. Act as the internal point of contact for the Law Firm for:

  • Court cases
  • Consumer complaints
  • Arbitration or mediation matters
  • Police or authority-related legal correspondence

13. Track litigation status, hearing dates, and compliance actions, and update management regularly.

F. RECORD KEEPING & DOCUMENT CONTROL

14. Maintain a centralized legal document repository (physical + digital) containing:

  • All executed and registered agreements
  • Legal opinions from the Law Firm
  • Notices, replies, and correspondence
  • Authority and court documents

15. Ensure document versions and records are consistent with those held by the Law Firm.

G. INTERNAL LEGAL SUPPORT & CROSS-TEAM COORDINATION

16. Coordinate with the Accounts team and Law Firm on:

  • Stamp duty calculations
  • Registration expenses
  • Legal aspects of TDS and statutory payments

17. Support the Sales & Marketing team (post-launch) by:

  • Coordinating sale agreement drafts with the Law Firm
  • Ensuring legally compliant allotment letters and customer documentation

 

QUALIFICATIONS & EXPERIENCE

  • LL.B (Mandatory) | LL.M preferred
  • 8–10 years’ experience in real estate redevelopment law
  • Strong experience in:
  • Society redevelopment documentation
  • Registrations and stamping
  • RERA compliance
  • Coordinating with external Law Firms
  • Mumbai redevelopment experience is mandatory

SKILLS REQUIRED

  • Excellent drafting and legal coordination skills
  • Strong ability to work with senior advocates and law firms
  • High attention to documentation and compliance
  • Ability to manage sensitive society and member matters
  • Strong communication skills (English & Marathi preferred)
