This Privacy Policy ("Privacy Policy") applies to your use of (a) the website: https://apna.co ("Platform"), and (b) the services offered through the Platform (hereinafter collectively referred to as "Services"), that is owned, controlled and operated by Apnatime Tech Private Limited ("Apna", "we", "us" or "our"), a company established under the laws of India, having its corporate office at 1st Floor, Tower A, 150, Bizzhub Esquire, Old Airport Road, Diamond District, Kodihalli, Bengaluru, Bengaluru Urban, Karnataka, 560008. For the purposes of the Privacy Policy, "you" and "your" shall mean the user of the Platform and the Services, whether registered or not ("User").

This Privacy Policy sets out what data we collect and how and why we use it, when you access the Platform and the Services. You are advised to read the Privacy Policy carefully before accessing the Platform and any Services. To access the Platform and any Services, you are required to accept the terms of this Privacy Policy. BY ACCEPTING THE TERMS OF THE PRIVACY POLICY, YOU EXPRESSLY CONSENT TO APNA'S COLLECTION, RETENTION, ANALYSIS, USE AND DISCLOSURE OF YOUR PERSONAL DATA IN ACCORDANCE THEREOF.

1. Objective & Scope

Apna is committed to protecting Users' privacy. This Privacy Policy applies to our Users and governs the use of the Platform and the Services, and any new feature or tool which may be added to the Platform. By way of this Privacy Policy, we aim to provide you a summary of our privacy practices regarding Personal Data (defined below) that we collect and process of/about the User through various sources. Depending on the purposes of processing and your relationship with us, we may provide additional customized privacy policies.

This Privacy Policy covers the categories of Personal Data collected, how we use or process such data, who are the recipients of such data, and your associated rights under applicable laws.

  1. 1. In order to access/use the Platform and the Services, you may be required, from time to time, at the request of Apna, to provide certain Personal Data, such as your first and last names, location, email address, residential and/or workplace address, mobile number, postal code, etc.

  2. 2. When you use our Platform or Services, we collect information provided by you which includes your inputs, file uploads, and outputs generated by the Services.

  3. 3. We may also automatically receive, collect, store and process certain data sourced by your usage of the Platform and the Services, such as standard usage logs, through the web server, cookies, standard web log data, traffic to and from our Platform, tracking within the same, and any other available data from:

    1. a. an IP address, assigned to the Device (as defined below) used by the User;

    2. b. type of browser used by the User;

    3. c. the domain server through which the User accesses the Platform and the Services;

    2. b. shared with or by any of our employees and affiliates;

    3. c. our sales or marketing representatives (including third party representatives), vendors, suppliers and service providers;

    4. d. sourced from public websites and social media, including but not limited to your publicly accessible profiles, etc.; and

    5. e. sourced via cookies and similar tracking technologies as deployed on our Platform.

3. Method and Manner of Use of Personal Data

We may use your Personal Data for the following purposes:

4. Access and Updation of Personal Data

It is important that the Personal Data we hold about you is accurate and current. You can request access to your Personal Data or correct or update out-of-date or inaccurate Personal Data we hold about you. You may also request that we delete Personal Data that we hold about you. For these or any other requests, or if you have a question regarding our privacy practices, please contact us at support@apna.co. You may also contact us on the aforementioned email address to revoke your consent to collection of Personal Data.

Please note that we have 15 (fifteen) days to respond to you and your requests. Further, we may ask you to verify your identity before responding to your requests. Any request made in accordance with the above and this paragraph will be addressed free of cost, provided however, we may charge a reasonable administrative fee if your request is unreasonable, repetitive or excessive.

You acknowledge that if we determine that any Personal Data is not accurate or current, we have the right, in our absolute discretion, to restrict your access and use of the Platform and the Services and delete or destroy such Personal Data without incurring any liability to you.

We are not responsible for the authenticity (or inauthenticity) of any information (including the Personal Data) supplied by you to us.

5. Sharing of Data

We will not use Personal Data for any purpose other than in connection with the Platform and the Services. You understand that we may share the Personal Data with third parties in connection with our Platform and the Services as may be required, and you explicitly agree to such Personal Data being shared.

We may use or enable any access or use of the third-party services through the Platform and as part of our Services. Where we use third-party tools, these third parties will have access to some of your Personal Data, including analytics tools. In such cases, your Personal Data will be collected and processed in accordance with the third parties' privacy policies.

When accessing/using the Platform and the Services, in the event you are directed to a third party website or application, and if you choose to access them (or avail what such websites have to offer), we will not be responsible for any such third-party websites or applications. Please note that in case you share any data with such third parties, you will be bound by their respective privacy policies and/or terms of use/service.

6. Data Retention and Erasure

If you no longer want Apna to use your Personal Data to provide access to the Platform and the Services (or any part thereof), you can request that we erase this Personal Data and close your User account. Provided, however, any requests for erasure, or closure of User account, will be acted upon in accordance with applicable laws and may adversely impact Apna's ability to provide access to the Platform and the Services to you. You hereby agree and acknowledge that a mere request for erasure does not guarantee an immediate erasure of Personal Data, and all such requests will be acted upon in accordance with applicable laws and our internal policies.

Please note that if you request the erasure of your Personal Data:

  1. i. we may retain some of your Personal Data as necessary for protecting our legitimate business interests, such as fraud detection and prevention and enhancing safety;

  2. ii. we will not be required to delete any information which has been de-identified or disassociated with personal identifiers such that it can no longer be used to reasonably identify a particular individual; and

  3. iii. Apna will not be able to provide you with access to the Platform or the Services (or any part thereof) and you should cease and desist from using the Services.

Consent; Withdrawing Consent and Restriction of Processing: In the event you do not consent to sharing your Personal Data with us for provision of access to the Platform and the Services (or any part thereof), we reserve the right to restrict or deny you the access to the Platform and the Services (or any part thereof).

7. Data Security

User data transmitted over the internet is protected through the use of encryption, using the secure socket layer (SSL) or equivalent protocols. We shall use generally accepted industry standards to protect the Personal Data submitted to us, both during transmission and upon receipt.

However, please be advised that no method of transmission over the Internet, or method of electronic storage, is 100% secure.
