Job Purpose:
Responsible for the comprehensive management of contracts, ensuring that all contractual obligations are met, risks are mitigated, and the company's interests are safeguarded throughout the lifecycle of projects. The individual will possess a deep understanding of FIDIC rules and be proficient in Contract Management Software (ICM). The role involves due diligence, drafting critical correspondence, record-keeping, and defending the company's position in contract-related matters.
Contract Management and Compliance:
- Review and maintain a Contract Appreciation Document to fully understand the nuances of each contract.
- Summarize the Salient Features of Contracts and Projects for quick reference and compliance tracking.
- List, monitor, and ensure the fulfilment of contractual obligations by both parties, maintaining rigorous follow-up procedures.
- Review and maintian Monthly Contracts Monitoring (MIS) reports.
Risk Mitigation and Documentation:
- Proactively identify potential risks in contracts and develop appropriate mitigation strategies.
- Keep track of delay events, document them meticulously, and manage comprehensive records for all contract-related activities.
- Ensure that all contractually significant correspondence is responded to promptly and that a detailed log of communications is kept up-to-date.
- Ensure that complete documentation of contractual importance is maintained at HO and Sites.
Variation & Financial Control:
- Identify and document any extra items or changes in scope to ensure accurate billing and payment.
- Monitor potential contract variations, assess their impact, and communicate with stakeholders to guarantee their proper management and realization.
- Maintain meticulous records for Extension of Time applications, providing justification or defense as required to protect the company's financial interests.
Dispute Resolution and Project Acquisition Support:
- supervise the drafting activity of critical correspondence, notices, including Applications for Extension of Time, Change of Scope, and Force Majeure Events, NOD, to safeguard the company's legal and commercial interests.
- Prepare Statement of Claim and Rejoinders to effectively handle disputes or arbitration.
- Conduct Due Diligence of bid documents and/or M&A related documents in case of bidding for the new Projects/ Merger and Acquisition of other Entities.
- Proficiently able to work with the latest technology contracts, such as blockchain, smart contracts and AI.
