Responsibilities:

As a consultant in our Regulatory Business Solutions practice, you will play a pivotal role in helping our clients navigate the complex landscape of data protection laws and mitigate risks associated with commercial contracts. You will be responsible for leading engagements, managing teams, and delivering high-quality, pragmatic advice to a diverse portfolio of clients.

Basic Qualifications:

- Degree Required: Bachelor of Law (LL.B) or equivalent from a recognized university or above.

- Years of Experience: 5 year(s) of post-qualification experience in a combination of data privacy, contract review, and compliance roles, with at least 2 years at a senior consultant or similar level.

- Certifications: Relevant certifications such as CIPP/E, CIPP/A, CIPT, CIPM, or the DSCI Certified Data Protection Officer (DCDPO).

Preferred Qualifications:

Technical expertise: Knowledge of IT systems, cybersecurity practices, data encryption, data discovery, and privacy-enhancing technologies.

Legal Knowledge: In-depth knowledge of the DPDPA, 2023, along with a strong understanding of global privacy regulations like GDPR, is highly desirable.

Role and Responsibilities:

Demonstrates extensive abilities and/or a proven record of success in the following areas:

Data Privacy & Contracts Review & Compliance:

- Leading client conversations and independently handling data privacy gap assessments against Indian data protection regulations, including the Digital Personal Data Protection Act, 2023 (DPDPA) and rules and International laws like GDPR, HIPAA and CCPA etc.

- Extensive experience in conducting assessments and audits: Oversee and conduct Data Protection Impact Assessments (DPIAs) for high-risk processing activities to identify and mitigate privacy risks.

- Develop and maintain an incident response plan to ensure timely detection, containment, and reporting of data breaches to the Data Protection Board of India (DPBI) and affected individuals.

- Grievance redressal: Implement an effective grievance redressal mechanism and act as the primary point of contact for data principals to address their queries and requests.

- Managing data subject request processes and conducting Data Protection Impact Assessments (DPIAs).

- Drafting and reviewing privacy notices, privacy policies, and other compliance documentation.

- Strong analytical and technical contract review, drafting and negotiating capabilities

- Training: Create and deliver targeted training and awareness programs to educate employees on their data protection obligations and foster a culture of privacy compliance.

Contract Review & Compliance:

- Strategic Contract Review & Negotiation:

· Leading the review, redlining, and negotiation of a high volume and variety of commercial contracts (e.g., MSAs, SaaS agreements, NDAs, Procurement contracts).

· Applying deep legal and business acumen to advise on fall-back positions and alternative clauses to achieve business objectives while mitigating risk.

· Developing, enhancing, and maintaining a Golden Clause Library and standardized contract templates to ensure consistency and efficiency across the organization.

· Creating and implementing detailed contract playbooks that provide clear guidance on negotiation strategies, risk thresholds, and approval workflows.

· Utilizing technology to manage and deploy contracting assets effectively

Client & Team Management:

- Independently leading conversations with the clients on multiple engagements simultaneously, ensuring the delivery of projects on time and within budget.

- Coaching and supervising junior team members, fostering an environment of continuous learning and development.

- Building and maintaining strong client relationships, effectively communicating complex legal and regulatory concepts in a clear and business-friendly manner.

- Open to travel

- Handle regular reporting and MIS maintenance and practice order book
